stop you for undefined suspicious driving.
- The police must follow specific
procedures in administering a breathalyzer
test for it to be admissible.
- The police must follow specific
procedures in administering field sobriety
tests according to the training they
received at the police academy, or the
results are not scientifically valid.
In other criminal cases:
- The police must have a legitimate reason
to search your person, your home, or your
vehicle, or they have violated your rights
under the Constitution.
- The prosecutor must provide scientific
proof that any substance is an illegal drug.
- The prosecutor must follow explicit
rules of evidence and disclosure before he
or she can present anything in court.
These are just a few examples. There are many
legitimate defenses that may apply in your case.
And there are countless ways a criminal case can
play out in court. That's why I always say no
case is unwinnable. Even if the facts
look bad, witnesses and evidence can disappear,
cops can fail to show up, prosecutors make
mistakes, and judges and juries can be
unpredictable.
